Questions clients often ask.

When is a dismissal lawful in Serbia?

The Labour Law sets out the grounds for termination and the procedure the employer must follow, including a written warning where required and a written decision. Whether a specific dismissal is lawful is assessed against those rules and the facts of the case.

Is there a deadline to challenge a dismissal?

Yes. The Labour Law sets a deadline for bringing a claim before the court, running from service of the decision or from learning of the violation. It is therefore important to act as soon as the decision is received.

Do you represent employers and employees?

Yes. The office drafts employment contracts and advises employers, and represents employees in protecting their employment rights and in labour disputes.

What is a disciplinary proceeding?

A procedure in which the employer establishes whether the employee breached work duties or discipline and imposes a measure provided for by the Labour Law, the employer's general act or the employment contract.
